Information About Brokerage Services
As required by the Texas Real Estate Commission (TREC), the following document provides information about brokerage services. Before working with a real estate broker, you are entitled to know the type of services the broker can provide and the scope of the relationship between you and the broker.
Types of Real Estate License Holders
A Broker is responsible for all brokerage activities, including acts performed by sales agents sponsored by the broker. A Sales Agent must be sponsored by a broker and works with clients on behalf of the broker.
Broker's Minimum Duties
A broker owes you the following minimum duties: (1) put your interests above the broker's interests; (2) inform you of any material information about the property that the broker knows; (3) answer your questions honestly; (4) treat all parties fairly; (5) comply with all applicable laws and rules.
Types of Representation
- Seller's Agent: Represents the seller/landlord and owes fiduciary duties to the seller/landlord.
- Buyer's Agent: Represents the buyer/tenant and owes fiduciary duties to the buyer/tenant.
- Intermediary: Represents both parties with written consent. The broker may not advocate for one party over the other.
